Terms for using HitoTCG

1. Agreement to these Terms

These Terms of Service ("Terms") govern your use of the Hito mobile apps, website, and related services (together, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Who may use Hito

You may use Hito only if you can legally agree to these Terms or if a parent or guardian agrees for you. Hito is not directed to children under 13. You are responsible for complying with laws that apply to your use of the Service.

3. What Hito provides

Hito provides tools for:

• Scanning and identifying trading cards using your device camera.
• Searching card catalog data and viewing card details, variants, images, and market price data.
• Managing a local card collection, folders, conditions, quantities, purchase details, grading details, and notes.
• Building and validating decks from card catalog and collection data.
• Tracking portfolio values and sealed product values based on available market data.
• Importing and exporting collection data with CSV tools.
• Creating optional price alerts where available.

Features may vary by platform, country, app version, store rules, device capability, network availability, and free or paid access level.

4. No account and local-first data

Hito is designed to work without a user account. Most collection and deck data is stored locally on your device. You are responsible for backing up data you care about, including by using CSV export where available. If you delete the app, clear app data, replace your device, or disable device backup, you may lose local data.

5. Camera, scanning, and recognition accuracy

Card recognition can be affected by lighting, card condition, image quality, language, variants, glare, database coverage, and network availability. Hito may misidentify cards or variants. You should review scanner results before relying on them or adding cards to your collection.

6. Prices, values, and alerts are informational

Price data, market values, portfolio values, sealed product values, charts, and price alerts are provided for general informational and collection-management purposes only. They are not appraisals, purchase recommendations, sale recommendations, investment advice, tax advice, insurance advice, or guarantees of resale value.

Market data may be delayed, incomplete, unavailable, inaccurate, or based on third-party sources with their own methods. Actual prices can vary by card condition, grading, language, region, fees, shipping, marketplace rules, liquidity, seller reputation, and transaction timing. You are responsible for independent verification before buying, selling, trading, insuring, or valuing cards.

7. Paid features, subscriptions, and purchases

Some features may require a paid purchase, subscription, lifetime unlock, free trial, or other paid access level. Paid access is sold through the Apple App Store or Google Play where available and may be managed with RevenueCat for entitlement validation.

• Store purchases are processed by the applicable app store, not directly by Hito.
• Subscriptions, if offered, renew automatically unless cancelled according to the applicable store rules.
• Trials, pricing, taxes, renewal terms, cancellation steps, and refund eligibility are controlled by the applicable store and shown before purchase.
• You can manage or cancel subscriptions through your Apple App Store or Google Play account settings.
• Refund requests should be made through the app store that processed the purchase, unless applicable law requires otherwise.
• We may change paid features, prices, packages, or trial availability prospectively, subject to store rules and applicable law.

Your use of store purchases is also governed by the Apple Media Services Terms and Conditions or Google Play Terms of Service, as applicable.

8. Your content and responsibilities

You are responsible for collection entries, deck names, notes, import files, exported files, support messages, and any other information you enter or submit. You must not use the Service to:

• Violate laws, regulations, sanctions, or third-party rights.
• Upload, send, or store unlawful, harmful, abusive, defamatory, invasive, or infringing content.
• Reverse engineer, scrape, overload, attack, disrupt, or bypass restrictions on the Service.
• Use automated systems to access the API or website without permission.
• Misrepresent affiliation with Hito, card publishers, marketplaces, or data providers.
• Use Hito to support counterfeit, fraudulent, or deceptive card transactions.

9. License to use the Service

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the Hito app and website for your own collection-management purposes. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Service except as allowed by applicable law or by store terms that cannot be waived.

10. Intellectual property

Hito, HitoTCG, app design, software, logos, text, and original content are owned by us or our licensors and are protected by intellectual property laws. The Service may display third-party card names, images, marks, game terms, market data, and other materials owned by their respective rights holders. Those materials are used for identification, compatibility, catalog, collection-management, or informational purposes.

Hito is unofficial and is not affiliated with, endorsed by, sponsored by, or certified by Bandai Namco Entertainment, Toei Animation, Eiichiro Oda, Shueisha, TCGplayer, or any other card publisher, marketplace, or rights holder unless expressly stated.

11. Third-party data and services

The Service may rely on third-party platforms and data providers, including app stores, RevenueCat, push notification providers, card catalog sources, image hosts, and market price sources. We do not control third-party services and are not responsible for their content, availability, accuracy, policies, or practices. Third-party terms and privacy policies may apply.

This product may use TCGplayer-linked data, but it is not endorsed or certified by TCGplayer.

12. Service changes and availability

We may add, remove, suspend, limit, or change features, catalog coverage, prices, data sources, paid access rules, APIs, and platform support. We may suspend or stop the Service if needed for maintenance, security, legal compliance, provider issues, store requirements, abuse prevention, or business reasons.

13. Termination

You may stop using Hito at any time. We may suspend or terminate access to online features if you violate these Terms, create security or legal risk, misuse the Service, or if we discontinue the Service. Local app data on your device may remain until you delete it, clear app data, or uninstall the app.

14. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and error-free operation.

We do not warrant that card data, prices, scanner results, deck validation, portfolio values, exports, alerts, or online services will be accurate, current, complete, uninterrupted, or suitable for your intended purpose.

15. Limitation of liability

To the maximum extent permitted by law, HitoTCG and its operators, developers, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, purchase or sale losses, collection valuation errors, device issues, or service interruption, even if we have been advised of the possibility of those damages.

To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid to us through the app stores for the Service in the 12 months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

16. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless HitoTCG and its operators, developers, service providers, and licensors from claims, damages, liabilities, costs, and expenses arising from your misuse of the Service, violation of these Terms, violation of law, or infringement of third-party rights.

17. Consumer rights

Nothing in these Terms limits rights you have under mandatory consumer protection, privacy, app store, or digital content laws that cannot be waived by contract. If a provision of these Terms is unenforceable, the remaining provisions remain in effect.

18. Disputes and applicable law

Please contact [email protected] first so we can try to resolve any issue informally. These Terms are governed by applicable law, excluding conflict-of-law rules, except that mandatory local consumer laws may apply depending on your residence. Courts with proper jurisdiction under applicable law will handle disputes that cannot be resolved informally.

19. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users, such as updating this page, changing the effective date, or providing an in-app notice where appropriate. Continued use of the Service after changes take effect means you accept the updated Terms.
